If you can't explain how you made that hire, you're already exposed
Most organisations can tell you what tools they use to screen candidates. Fewer can tell you how those tools arrive at a decision. And very few can produce, under scrutiny, a clear account of which criteria were weighted, where automation played a role, what was filtered out, and who was accountable for the outcome.
That's where exposure begins. Not when a hire goes wrong. It begins the moment your process can't explain itself.

The accountability gap is already built in
The OECD's 2025 survey of more than 6,000 firms found that two-thirds of managers using algorithmic management tools cited unclear accountability and an inability to follow the logic of automated decisions as direct concerns. These are the people operating the systems daily, and they're telling you they can't fully explain what those systems do.
This is a governance problem. Hiring processes have been assembled over years by layering tools on top of each other: an ATS here, a screening platform there, an AI-powered shortlisting feature added last quarter. Each component may work as intended. But the overall process, the chain of decisions from application to offer, often has no single owner, no documented logic, and no audit trail connecting input to outcome.
When a decision is challenged, you need to reconstruct it. Which criteria did the system apply? Were any candidates excluded before a human saw them? On what basis? Was the weighting validated against bias? Who reviewed the shortlist, and what did they actually assess versus what the algorithm pre-determined for them?
If those questions can't be answered from your records, the defensibility of that decision rests on memory, assumption, and good faith. None of those hold up in a tribunal, a regulatory inquiry, or a board-level review.
The regulatory picture is tightening
The regulatory direction across jurisdictions converges on the same expectation: if you use AI in hiring, you need to be able to show your working.
The EU AI Act classifies recruitment AI as high-risk and, from August 2026, requires technical documentation of how the system works, bias audits, ongoing performance monitoring, and meaningful human oversight. The Act reaches any organisation whose AI output affects an EU-based candidate, regardless of where the company sits. In Australia, a parliamentary committee recommended in February 2025 that all employment-related AI be classified as high-risk and that the Fair Work Act be amended so employers remain liable for automated decisions. Singapore's MAS guidance on AI risk management requires board-level accountability and documented governance arrangements for financial institutions using AI. In the United States, the federal picture has shifted, but Title VII still treats algorithmic tools as selection procedures, and states are acting independently: Illinois requires consent for AI video analysis, Colorado prohibits algorithmic discrimination in consequential decisions, and New York City mandates bias audits for automated hiring tools.
The specifics vary. The principle doesn't. If you can't document how a decision was made, you can't defend it.
What defensibility actually looks like
Saying "a human reviews every decision" isn't sufficient if that human is approving an algorithmic recommendation they don't understand. Rubber-stamping isn't oversight.

Defensibility means being able to describe, in plain language, what criteria the system uses and how they're weighted. It means knowing which candidates were filtered out before a human saw them, and on what basis. It means having evidence that the system's logic has been tested against bias and accuracy on an ongoing basis, not only at procurement. And it means clear accountability: a named person or function responsible for the process, its outcomes, and its failures.
The UK DSIT guidance on responsible AI in recruitment frames this as a lifecycle requirement. Governance frameworks, impact assessments, bias audits, performance testing, and user feedback mechanisms run continuously across the system's operation. The ILO's 2025 working paper reinforced why this matters: when organisations treat AI outputs as objective by default, they stop interrogating the assumptions baked into the system. The governance layer is what forces that interrogation to keep happening.
This also applies to third-party tools. Using a vendor's platform doesn't transfer liability. If the tool produces a discriminatory outcome, the employer bears the legal exposure. That means procurement decisions are governance decisions. If you can't audit a vendor's model, you can't defend the decisions it makes on your behalf.
The question isn't whether scrutiny will come
Regulatory timelines are tightening. Candidate expectations around transparency are rising. And the more AI is embedded in your hiring process, the more decisions are being made that no one in your organisation can fully trace.
The organisations that will be caught out aren't necessarily the ones that made a bad hire. They're the ones that made a reasonable hire but can't prove it, because the process was never documented and the accountability was never assigned.
If someone asked you today to explain, step by step, how your last hire was made (who decided, what the system filtered, why that candidate over another) could you answer from your records? If not, the exposure already exists. The only question is when it surfaces.
